Changes to the Construction Act

The Local Democracy, Economic Development and Construction Act 2009 came into force on the 1st October 2011 and amends the provisions of the Housing Grants, Construction and Regeneration Act 1996.  Any construction  contract  entered into after the 1st October 2011 has to comply with the new provisions and where it does not then statutory provisions will apply.The new Act increases the complexity of the payment regime and potentially increases the number of notices that will be issued. It also provides wider provisions in respect of suspension and amends the provisions for contracts to be in writing, along with changes to insolvency and Adjudication provisions.
